Prior to the wedding, both parties, the Videographer and the Client, will engage in a pre-event discussion or phone call, scheduled at least 7 days before the wedding day. This conversation aims to finalize the event's schedule, discuss locations, and address any specific requests the Client may have regarding the film. The Videographer requires all detailed video requests to be submitted no later than five days before the event date.
A 50% retainer fee must be paid within 10 days of signing this Agreement to confirm the booking. The client has a 14-day cooling-off period during which this fee is refundable. After this period, the retainer fee becomes non-refundable. The agreed date will not be reserved until the Agreement is fully executed and the retainer fee is received. Upon payment, the Videographer will reserve the agreed-upon time and date. The client agrees that this non-refundable payment is earned by the Videographer upon receipt and reflects the Videographer's experience, reputation, skill, and the commitment to reserve the date, preventing other bookings during this time.
The remaining 50% balance of the final invoice is due at the end of the wedding day. Once payments are made, they are non-refundable. If complete payment of the balance owed is not received at least 6 weeks prior to the event date, the Videographer may be relieved of all remaining contractual obligations, and the Client will be responsible for the full amount outlined in this Agreement.
Acceptable payment methods include cash or E-transfer. The Client assumes responsibility for any and all collection costs and legal fees incurred by the Videographer in the event that enforcement of this Agreement becomes necessary.
If the Client cancels this Agreement less than 40 days before or on the wedding date, the initial nonrefundable payment and any additional fees paid to the Videographer will be retained by the Videographer. Cancellations must be submitted in written form and signed by all parties involved.
If the Client submits a written request to change the event date at least 40 days before the original date, the initial nonrefundable payment can be applied to the new date within the next calendar year, provided the Videographer is available. If the request is made within 40 days of the original event, the Client may need to pay a new initial nonrefundable payment as per the current rates listed in the Videographer’s Standard Price List. Approval for rescheduling is at the discretion of the Videographer.
If the Videographer is unable to fulfill this Agreement due to factors like illness, emergency, natural disasters, or other unforeseeable causes beyond their control, efforts will be made to arrange for a Substitute Videographer as per this Agreement.
The videographer will suggest an alternative videographer assuring that the alternative will meet comparable standards of quality and professionalism.
If the alternative cannot be perforeme for the scheduled date, the Client's option is limited to requesting a refund of all payments to SAEED PRODUCTION INC, with no further legal action against them. In such a case, the Videographer will:
If the services are canceled after they have started but before completion, fees will be calculated and invoiced according to the Videographer’s regular pricing.
The Client agrees not to hire another videographer for the event. However, the Client may hire photo booth operators and photographers, provided their primary service does not involve video coverage.
For collections that include a Secondary Shooter, the Videographer has the authority to choose the individuals for this role.
The Videographer maintains full copyright of all video content produced under this Agreement, including both raw and edited versions.
Videos will be edited at the Videographer’s discretion, and the final product will only include clips that meet their professional standards.
The Videographer will aim to deliver results that match the Client's preferences, reflecting the style seen in their portfolio and considering reasonable suggestions from the Client. However, the Client agrees:
While the Videographer will consider the Client's preferences, the final aesthetic and creative decisions lie with the Videographer. Lists provided by the Client for specific shots are for organizational purposes and do not guarantee inclusion in the final video.
The Videographer is required to adhere to the venue’s guidelines and policies. The Client agrees to accept any technical limitations these guidelines may impose. It is the Client's responsibility to negotiate any changes to these policies. Any permits or fees required by the venue or local authorities are also the Client's responsibility.
The Client agrees to make every effort to ensure that guests and attendees treat the Videographer and their team with respect and dignity, providing a secure and safe working environment.
If any issues arise, the Videographer will attempt to contact the designated Point of Contact to resolve the matter. If the situation is not resolved within a reasonable timeframe, the Videographer reserves the right to terminate the remainder of the event coverage.
Issues affecting a safe working environment include, but are not limited to, instances of sexual harassment, violence, threats, or other behaviors that would reasonably make someone feel unsafe. If such a cancellation occurs, the Client will not be eligible for any refund.
The fees outlined in this Agreement are based on the Videographer’s Standard Pricing. This pricing is subject to periodic adjustments. The rates specified at the time of this Agreement will be honored for up to three (3) months. After this period, any new orders will be charged according to the prevailing rates at the time the order is placed.
All prices include sales tax, shipping, and any applicable fees.
The completion timeframe and delivery of products are estimated to be within a single month only.
The Videographer is obligated to follow the rules and policies established by the venue authorities or management. The Client acknowledges and agrees to the technical impact these regulations may have on the Videographer's tasks. It is the Client's duty to negotiate any alterations to these regulations with the venue officials. Furthermore, the Client is responsible for any supplementary permits or fees mandated by the venue or local authorities.
